What you can recover
Past and future care: ER, imaging, surgery, physical therapy, prescriptions, and long-term needs.
Income you've already lost, plus future earning capacity if your injuries keep you from your prior work.
Physical pain, mental anguish, and lost enjoyment of life, where the law of your state allows.
Repair or replacement of your vehicle, rental costs, and personal property damaged in the crash.
Florida law basics
For crashes on or after March 24, 2023, you generally have 2 years to file, under HB 837.
To access your $10,000 in PIP, you must be evaluated by a qualifying provider within 14 days of the crash.
Modified comparative negligence applies. If a jury finds you more than 50% at fault, recovery is zero.
This is general information about Florida law, not legal advice. If your accident happened in another state, different deadlines and rules apply; we handle claims in all 50 states. Talk to an attorney about your situation.
