Cancellation of removal is one of the most powerful defenses in immigration court, and one of the least forgiving. It is only available inside removal proceedings, you generally get one chance at it, and the judge's discretion decides the ending. Verde Law builds cancellation cases the way they have to be built: with years of a life documented and a hardship story the judge cannot look away from.
Cancellation for people without a green card
If you are not a permanent resident, you may qualify by proving all of the following:
- 10 years of continuous physical presence in the United States
- Good moral character during that period
- No disqualifying criminal convictions
- Exceptional and extremely unusual hardship to your U.S. citizen or permanent resident spouse, parent, or child if you were deported
Win, and the judge can grant you a green card.
Cancellation for permanent residents
Green card holders facing deportation, often because of a criminal issue, have their own version. It generally requires 5 years as a permanent resident, 7 years of continuous residence after a lawful admission, and no aggravated felony conviction. Win, and you keep your green card.
The hardship standard is brutal on purpose
"Exceptional and extremely unusual" means more than the ordinary pain of family separation, and judges deny cases that only show the ordinary. We build hardship with medical records, school and special-needs documentation, psychological evaluations, financial evidence, and country condition reports that show what deportation would actually do to your family. That is the difference between telling the judge your children would suffer and proving it.
The stop-time rule
Your 10 years of presence generally stop counting when the government serves a proper Notice to Appear. Whether your notice actually stopped the clock is a legal question that has been fought all the way to the Supreme Court, and timing analysis can decide the case. Bring us every document you have received.
One more reality: the annual cap
Congress limits how many of these green cards can be granted each year, so even strong cases can wait. We prepare for that from day one.
Can I apply for cancellation with USCIS?
No. Cancellation of removal only exists inside immigration court. It is a defense, not an application, which is one reason experienced court counsel matters.
What if my case falls short on one requirement?
Then cancellation may be the wrong tool, and something else may be the right one. We evaluate every defense before choosing, not after losing.
